Can an OCI cardholder give POA to her/his father-in-law to sell her/his flat in Bangalore?

Yes,

OCI cardholder can give POA to father-in-law to sell flat in Bangalore

But the stamp duty is high for giving POA to father-in-law. Father-in-law comes under non-blood relative category. The stamp duty for non-blood relative is high compared to blood relative catergoty.

Following people come under blood relative category

  • Father
  • Mother
  • Brother
  • Sister
  • Husband
  • Wife
  • Children

The stamp duty for blood relative is just Rs. 200

In-laws, cousins, friends, colleagues, advocates, and brokers come under non-blood category.

The stamp duty for non-blood relatives is 5% of property value. For example, your property value is Rs. 50 lakh. The stamp duty is Rs. 50 lakh X 5% = 2,50,000/-

Rs. 2.5 lakh paid at the time of POA adjudication in India, which could be huge stamp value compare to blood relative stamp value of Rs. 200.
