How do I transfer a joint property to a single name?


Transfer joint property to a single name by registering RELEASE DEED.

Let me give an example:

In January 2015, wife and husband jointly purchased a flat in Bangalore from a builder. Refer to below sale deed:

1st page consists of seller details.

2nd page consists of buyers details (joint purchase of wife and husband).

In Encumbrance Certificate, Wife’s and husband’s names shown as owners of the property, Refer to arrow mark in below EC

In Jan 2024, Husband wants to release his share in property to his wife and make his wife as an absolute single owner of the property. We decided to transfer husband’s share to wife through RELEASE DEED.

We followed below steps to register Release Deed:

Step 1: Drafted the Release Deed in word document

Step 2: Submitted the RELEASE DEED application online (Kaveri Online Services in Karnataka)

Step 3: Paid the government fee. The government fee is Rs. 6350/- (including Stamp Duty, Registration and scanning fees).

Step 4: Booked an appointment for registration

Step 5: Registered the Release deed in Sub-registrar office. Refer to below Release Deed that husband is the Releasor and Wife is the Releasee.

Registered the Release deed Encumbrance Certificate Transfer joint property to a single name

In Encumbrance certificate, Only wife’s name shows as owner of the property. Refer to arrow mark in below image.

It means that we successfully transferred joint property to single name that wife becomes absolute single owner of the property.
