Yes. You can apply. There is a higher chance to get your passport without police verification if you apply before the expiry date but it depends on the sole discretion of the granting officers. Please note that I'm not assuring you on same. Don't have to bother  If you have no crime record in your native concerned.because it is a very simple process now.
