റദ്ദ് ചെയ്യാവുന്നതാണ്. എന്നാൽ സമീപപ്രദേശത്തുള്ള നെൽവയലുകളിലേക്കുള്ള നീരൊഴുക്കിന് ഭംഗം വരാത്ത രീതിയിൽ വസ്തു ഉടമ ഭൂവിനിയോഗം ചെയ്താൽ RDO ക്ക് മേൽപ്പറഞ്ഞ അധികാരം ഉപയോഗിക്കാൻ സാധിക്കുകയില്ല. മാത്രവുമല്ല സമീപപ്രദേശങ്ങളിൽ വയലുകളും തണ്ണീർത്തടങ്ങളും ഇല്ലാതിരിക്കുകയും, ഇല്ലായെന്ന റിപ്പോർട്ട് ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസർ അപേക്ഷ പരിഗണിക്കുന്ന സമയത്ത് RDO ക്ക് കൊടുത്തിട്ടുണ്ടെങ്കിലും *വകുപ്പ് 27A(11)* പ്രകാരം RDO ക്ക് അധികാരം ഉപയോഗിക്കുവാൻ സാധിക്കുകയില്ല.

സ്വഭാവ വ്യതിയാനം അനുവദിച്ചുകൊണ്ടുള്ള ഓർഡർ തിരിച്ചെടുക്കുവാൻ RDO ക്ക് അധികാരം നൽകുന്ന *വകുപ്പ് 27A(11)* ന് വളരെയേറെ പരിമിതികളുണ്ട്. പക്ഷേ ഭൂമിക്ക് സ്വഭാവവ്യതിയാനം നടത്തുന്നതിന് വേണ്ടിയുള്ള 27 A അപേക്ഷ പരിഗണിക്കുന്ന സമയത്ത് സമീപ പ്രദേശങ്ങളിലുള്ള ഭൂമിയിലേക്കുള്ള നീരൊഴുക്ക് ഉറപ്പുവരുത്തേണ്ടത് RDO യുടെ ഉത്തരവാദിത്തമാണ്.

RDO can cancel his oder issued u/s 27A(2), either by a suo moto action or on an application by the aggrieved party…But the cancellation can by done only when the party concerned is seen violated with the conditions provided in the order…Vasu Kallayi Vs State of Kerala is very good example…Here the Hon court set aside the order of cancellation of RDO  bcoz the case lacks conditions provided in section 27A(11). Plz see 2nd part of para 9 of the Judgement..According to the Court the impunged order was passed bacoz of ignorance of law.
